By hiring Casey Smith Real Estate Photography for the provision of any real estate marketing products or services, you are bound by the following terms and conditions. This constitutes a legal agreement between yourself and Casey and Monica Real Estate Marketing Pty Ltd. This agreement also applies to any usage of our real estate marketing products, regardless of whether you have engaged us or not, and we reserve the right to seek monetary compensation for any usage of our products or services.

Regarding Copyright/ Image Retention:

All images and files remain the copyrighted property of Casey Smith Real Estate Photography. We reserve the right to use and publish images for our own advertising, self-promotion, and in industry competitions. Under NO circumstances are any of the photos, videos, floor plans or copy-writing, or any other products or services we offer,  we supply to be altered in ANY way without our express permission.

Product Usage Rights: 

Limited usage rights are transferred to the paying client for the duration of the property listing. This is an individual and non-transferable license that allows use of the images for all marketing material and campaigns associated with promoting the specific property and the agent, for the duration of the listing.

This license is only granted to the paying client and not to any third party, including but not limited to builders, architects, staging professionals, other real estate agents, designers, publications, buyers or sellers. Use of the images by such third parties requires written permission from Casey and Monica Real Estate Marketing Pty Ltd, and will be invoiced accordingly.

Images cannot be sold or passed on to another agent who takes over an expired or withdrawn listing.

An exception to the third party is the home owner, who, upon request, will be provided a copy of the images for their personal, but not commercial, use. If said home owner passes on any of our marketing products to a third party. eg. a real estate agency, we will invoice that real estate agency for the use of those marketing materials.

If images are to be published in any sort of trade publication, written permission must be sought from Casey Real Estate Photography, and full credit to Casey and Monica Real Estate Marketing Pty Ltd is required.

Regarding the Photo Shoot:

All tenanted and vendor properties will be shot ‘as is’, and it is the responsibility of the client to ensure the property is ready for photos i.e. clean and devoid of clutter, before we arrive for the photo-shoot.

We will provide, if requested by the client, within reason and as we deem appropriate, advice and assistance with regards to minimal styling, if necessary, and for untenanted properties only. Please note that we do not charge for this additional service, and as such, any styling, removal of clutter etc. will be done entirely at our discretion. 

Regarding tenanted properties; they will be shot as is- no exceptions. If the client requires items to be moved or any styling to be done, the client must be present during the photo-shoot and ensure the property is photo-ready before we arrive. 

Any features of a property that may be considered to be detrimental to the sale of that property eg. power lines, holes in walls, broken fixtures or fittings etc., will not be removed from any images.
